The space

Our cozy condo is located on the second floor of the first building on your left as you enter the Coco Marindo complex.

The neighbourhood

When you arrive, the 24/7 security guard at the gate will need to see photo IDs for each member of your party. You'll also be required to sign a document from the HOA outlining the community's rules and your commitment to follow them.

House rules

The HOA for Coco Marindo is very strict, which helps ensure the enjoyment of the property by all. This is a copy of the document that the security guard will ask you to sign when you arrive. We've provided it here, so you don't have to read it while checking in if you don't want to. Our goal is to allow you to have the information you need while making the check-in process as smooth as possible. Sometimes, the guards can be very stringent.

COCOMARINDO RULES

PREFACE

The goal of the Condominium Rules is to make Cocomarindo safe, secure, and enjoyable for all based on the Condominium By-Laws (Reglamento) and Costa Rican legislation in a fair, logical, legal, and enforceable way.

Understanding the difference between our By-Laws (Reglamento) and Rules is essential. The By-Laws were written and legalized when the condominium was registered. The By-Laws describe the way our Condominium Association is created and governed. The By-Laws (Reglamento) is an official document registered in the Public Register. The Rules are an internal condominium document describing the day-to-day life and the implementation of the By-Laws.

There are only two types of people in Cocomarindo: Owners and Guests. Renters and contractors are considered Guests of their owners. Owners are responsible for ensuring their Guests are familiar with the Condominium Rules and comply with them.

COMMON AREA

The General Common Area is occupied and used equally and freely by all owners and guests of owners. This is the entire area of the pool, rancho, parking lots, walkways, trees, and shrubs. The Preferred Common Area, as described in the minutes of AGM2022, may be occupied and used by the owner or guest of that unit only. The HOA and Management Staff may enter this area without permission to perform general duties and maintenance. This includes the second level 2-bedroom balconies, the first level 2-bedroom patios, the area in front of the window of the first level 1-bedroom, and all first level units for 1 meter in front of the rear patio door.

The occupants of this Preferred Common Area may barbeque, cook, smoke, play music, play with their pet, or engage in any other normal residential activity as long as they do not bother their neighbors. If a neighbor complains, they must either stop the activity or find a solution. This is known as the Good Neighbor Rule. Costa Rica law states that your right to pursue your activity does not supersede your neighbor's right to peace.

The Private Area is described as the area inside the unit. This is the private area of the owner or owner’s guest. The owner may remodel, change the color, etc., but no structural changes may be done according to By-Law articles 23 and 24.

Moral norms and good manners must be respected, and the tranquility of the property owners should not be disturbed in any way (By-Law, article 17). Inappropriate behavior, including aggressive, offensive, drunk, noisy, careless, or dangerous behavior, is not acceptable.

Glass and ceramic items are not permitted in the General Common Area.

Only certified propane and electric BBQs may be used in the Preferred Common Area. All barbeques must be operated safely and never left unattended.

Yelling, loud music, smoking (including e-cigarettes), idling cars, and any strong smells are not permitted in the General Common Area. Music is allowed when kept at a reasonable volume (reasonable shall be defined as not bothering other owners or guests) between 8:00 am and 10:00 pm (By-Laws, article 31).

Bicycles, motor vehicles (cars, trucks, motorcycles, scooters, golf carts, ATVs, and electric vehicles), toys, garbage, or other personal property must not obstruct entranceways, walkways, or sidewalks in the General Common Area.

Fireworks and the starting of fires are strictly prohibited. Please note the location of the fire extinguishers.

The outside parking is also considered a General Common Area of Cocomarindo.

Retail businesses are not allowed in the residential area of Cocomarindo, as per Article 27 of the By-Law.

Any Rancho event (library and pool bar) or activities with many people must be approved by the administration. A reservation request must be submitted to the HOA no less than three days before the event.

No rough play, running, kicking balls, or destructive behavior that is annoying or potentially dangerous to people or buildings is allowed in the General Common Area. No mechanized toys, including radio-controlled boats, drones, or cars, may be used in the General Common Area.

Ground floor units may not obstruct the path at the rear of buildings, including clotheslines. The area one meter outward from the rear patio door on lower units will be considered Preferred Common Area. Clotheslines are only permitted behind the building, where the laundry machines are located.

Towels, swimsuits, or clothing may not be hung on balcony rails.

Personal items such as tables and chairs may not be stored in the General Common Area.

Only the condominium administrator may install video cameras (except for the condominium security system) with the permission of the General Assembly (AGM) of the condominium owners. The installation of cameras should not capture the private areas of the condominium owners. Signs should be installed to warn people which areas are under video surveillance. The person responsible for the records assumes responsibility for the database and must guarantee the rights of access, correction, cancellation, and objection, as guaranteed by Law 8968 of Costa Rica.

It is forbidden in the General Common Area to wash, clean, or operate with objects that emit a strong odor or dirt. This also applies to commercial units. Any activity outside the commercial unit other than loading and unloading is prohibited without the Administrator's approval.

Illegal substances are not allowed to be used or sold on the premises.

Any landscaping, planting, or other work in the General Common Area must be approved by the Administrator (HOA Board) in advance. If written consent is not granted, the work can be removed at the owner’s expense.

GARBAGE / TRASH

Trash must be put in sealed plastic bags and deposited in trash cans. Trash bags or trash of any kind are not allowed to be stored on terraces, balconies, or at the back of units at any time (By-laws, article 28). Owners are responsible for the cost of removal of large items considered extraordinary. These items may include indoor construction materials, sinks, toilets, furniture, bedding, televisions, AC units, and appliances.

LAUNDRY

The laundry facilities are solely for the use of Cocomarindo owners and guests on a first-come, first-serve basis. Reservations are not permitted. Guests not staying in the condominium are prohibited from using the laundry.

SWIMMING POOL AND JACUZZI

There is no lifeguard on duty. Any person is individually responsible for all possible problems. Children under 18 years of age must be accompanied and supervised by a parent or competent adult at least 18 years old. Pool hours are from 7 am to 10 pm. Everyone must shower before entering the pool.

Use of the pool is prohibited when an individual cannot take care of themselves due to drug or alcohol intoxication, evidence of contagious disease, open wounds, or sores. No running, jumping, diving, or rough play is allowed in the pool, jacuzzi, bridge, or common area.

Bathing suits are required for all persons of any age. Babies must wear swim diapers. No nudity or sexual behavior is allowed in the pool or General Common Area. Glass and ceramic items are prohibited in the pool area and sidewalks. No food is allowed within one meter of the pool.

No furniture of any kind is allowed within one meter of the pool. No foreign liquids or substances may be spilled into the swimming pool or jacuzzi. All drinks must be kept a safe distance from the pool edge to prevent spills. Drinks are not allowed in the pool swimming area.

RESIDENTIAL USE

Any harmful or offensive activity within the condominium unit that can be a nuisance to neighbors or other units is not allowed. Defacing of property, such as signs, notices, advertisements, or any alteration of exterior surfaces, is not permitted. Temporary decorations installed seasonally or approved by management are excluded from this rule, as is the notice board at the entrance gate (By-laws, Article 26).

WILD / FERAL ANIMALS

It is prohibited to feed, touch, or manipulate wild or feral animals.

PETS

Costa Rica law does not allow pet restrictions in a home. However, pets are not permitted in the General Common Area or pool. Pets must be kept on a leash when traveling to and from the unit. Owners must pick up after their pets and keep their Preferred Common Area clean and free of pet droppings. Owners must ensure that their pets' noise levels are reasonable (reasonable shall be defined as not bothering other owners or guests).

MOTOR VEHICLE PARKING

Only one vehicle is allowed per unit. Parking is on a first-come, first-serve basis. No one can reserve a parking spot. Once owners leave Cocomarindo, they must find a storage place for their vehicles. The vehicle cannot be left parked at Cocomarindo inside or outside of the commercial buildings. If left, the vehicle will be towed and stored at the owner’s expense.

Keeping the vehicle engine running while parked in the parking areas is prohibited. No repair, washing, or extraordinary maintenance of automobiles or other vehicles is allowed in the General Common Areas unless it is an emergency and cannot be towed. The owner must clean the area after repairs are completed, and the work must be finished in a timely fashion.

Motorcycles and scooters cannot use parking slots or sidewalks. Golf carts, ATVs, bicycles, scooters, and motorcycles must be parked in designated areas only. Vehicles will be permitted temporary entry for loading or unloading cargo and luggage. The vehicle owner must turn off the engine. The car must stop where indicated by the security officer or the person responsible from Management or HOA.

Owners and guests of owners living in Cocomarindo are allowed to use the parking spaces within Cocomarindo. However, contractors of owners and guests not living in Cocomarindo must use parking spaces outside of Cocomarindo. Vehicles without a registration plate, current circulation right (marchamo), or vehicles that are not in working order will not be allowed to park in Cocomarindo. This applies to inside or outside of the commercial buildings. These vehicles will be towed at the owner's expense.

According to the Decree of the Government of Costa Rica dated January 18, 2021, No. 42831, vertical or horizontal condominiums with more than thirty units require at least one parking space for every ten units, plus ten percent for visitors. The number of parking lots in Cocomarindo exceeds the Costa Rican law requirements.

According to Costa Rica Law Article 7 of Law No. 7600, private institutions providing services to people with disabilities and their families must provide truthful and understandable information about the services. Owners are responsible for informing guests that Cocomarindo does not meet the prerequisites for people with disabilities. Any parking slot dedicated to people with disabilities is also available for senior citizens (60+) and pregnant women.

MAINTENANCE / ARCHITECTURAL CONTROL

No structural alterations, additions, or removals on any condominium unit or common element are allowed without written permission from the administration. Refer to Articles 23 and 24 of the By-Laws of Cocomarindo for more details on maintenance and architectural control.

Owners must notify the HOA in writing at least one week before beginning any major construction or remodeling project in their unit. This gives the HOA time to notify adjacent unit owners about the noise that will occur. No excessive construction noise is allowed before 9 am or after 5 pm on weekdays, or on Saturdays or Sundays. Exceptions to this rule may occur in the case of emergency repairs, which will be carried out in a timely and considerate manner. Propane tanks are strictly prohibited inside condominium units. If barbeques are stored inside a unit, the tank must be disengaged and placed outside the unit.

GUARD / SAFETY

The guard is authorized to enforce all rules and has the authority to hold any person accountable for their actions. Guards are appropriately identified, and owners and guests must follow their instructions without exception. The guard may call the police if people resist.

People should not dispute or reference the language barrier with the guard. In case of disagreement, the person must still comply with the guard's request and later submit a written complaint via email to the HOA Board.

If the violator responds reasonably to the guard and follows instructions, the guard is not obliged to document the violation. Disrespect toward workers, administrators (HOA Board members), or managers will not be tolerated. Legal action may be taken, or entry to Cocomarindo may be denied, for any owner, guest, or rental agent who shows disrespect.

Any security officer, Administrator (HOA Board members), manager, or owner may ask for identification from any person in Cocomarindo if their presence is questionable. Owners or guests are not allowed to give any direction or orders to any Cocomarindo contractor, subcontractor, or their employees. This is a violation of the Cocomarindo contract with the contractor, and the violator will be fined. All requests must be submitted to the HOA for consideration.

CONDO FEES AND PAYMENTS

Every property owner is required to contribute proportionally to the value assigned to their property for administration and maintenance expenses, common expenses, insurance, water service, reserve fund, taxes (when applicable), and other budgets.

All owners who are not up to date with their contributions will be charged a late fee of $25 per month. The late fee consists of a penal clause and a service fee. The penal clause is based on the interest rates for commercial loans set by the Central Bank of Costa Rica, while the service fee is $25 minus the aforementioned interest. The late fee will be charged on a monthly basis.

If the debt is not paid within 30 calendar days, the water supply to the individual apartment will be stopped. The toilet and sink in the General Common Area will still be available. This condition complies with Costa Rica law, which allows the Administration to shut off a home’s water. A $50 one-time charge for the water cut will be added to the owner’s monthly statement. Additionally, the HOA Board is allowed to limit the use of the General Common Area, including the pool, jacuzzi, and parking, for the owner and guests of the apartment in debt. A notification letter will be posted near the apartment entrance. A $50 one-time charge for wall repair due to the posting will be added to the monthly statement of the owner.

If the debt is not paid within 60 days, legal action will be taken to claim the unpaid debt.

RENTAL PROPERTY

According to Cocomarindo By-Laws, article 30, if a property owner decides to lease their property, they must inform the Management Board. To facilitate this, the Management has authorized Security to handle the task. The owner is responsible for informing Security in advance of any guest arrival by providing the following information: unit number, full name of the guest (primary guest in case of several people), number of people, date of arrival, and date of departure.

Guests must register with Security upon first entering Cocomarindo. All names will be registered, and the unit number will be recorded. Entering Cocomarindo without proper registration or providing incorrect information is prohibited. Tenants must accept the Cocomarindo regulations in writing during registration. The owner is responsible for providing guests with a copy of the Cocomarindo Rules, which are available on the website. Owners must also inform their tenants of any rule changes. The unit owner will be responsible for any rule violations or damage to the General Common Area caused by the owner or their guests.

Vandalism is strictly prohibited. Unit owners and guests must not deface, remove, or destroy any element of the General Common Area. The unit owner will be held responsible for any damage incurred.

FOR SALE

According to Cocomarindo By-Laws, article 30, if a property owner decides to sell their property, they must inform the Management Board. As part of this communication, the HOA Board will provide the lawyer handling the transaction with a Certificate of Good Standing. No person or agent is allowed to enter the property unless the unit owner or agent has informed management and security. All persons must be registered before entering the property for safety and privacy reasons.

Any real estate agent who wishes to show a property to prospective clients must be fully accredited and cannot access the site by car. Condo sellers must include a current copy of all By-Laws and Rules in the sales process and require that the buyer acknowledges receipt of these documents.

OCCUPANCY

Costa Rican law does not allow occupancy limits in a condo. However, the HOA has the right to limit the number of people in the Common Area, including the pool. Owners who allow more people in their condo than the suggested maximum may be restricted from using the pool or Common Area.

For 1-bedroom units, the suggested maximum is 4 people, including children over 2 years old. For 2-bedroom units, the suggested maximum is 6 people, including children over 2 years old. All units, except commercial units, must be used for residential purposes only. Residents must abide by all By-Laws, Rules, and Regulations (By-Laws, article 27). Owners are encouraged to provide their guests with plastic dishes to avoid being warned, as glass and ceramic items are not allowed in the General Common Area. This will also prevent the owner from being fined.

FINES

According to the Ley Reguladora de la Propiedad en Condominio (The Vertical Condominium Law), which governs all condominium associations in Costa Rica, Article 23 states that if an owner violates the prohibitions and limitations contained in the law, the condominium regulations, or the condominium assemblies, the following sanctions may be imposed after due process: prevention in writing, sanction or fine, and obligation of eviction.

A verbal warning from the guard or another person is not considered a sanction. Its purpose is to inform the individual of a potential rule violation to help them avoid punishment. If the person ignores the verbal warning and continues to violate the rules, a video will be recorded documenting the behavior. Security will contact Cocomarindo Property Management, send them the video along with the unit number, and explain which rule was violated. Cocomarindo Property Management will then email the unit owner, assigning a fine with the violation date noted on the invoice.

A second violation of the same rule will result in an automatic fine. Fines are categorized as follows: $25 for late payment and $50 for all other rule violations unless covered by the By-Laws. Specific By-Law violations carry the following fines: $250 for By-Laws articles 22, 23, and 24; $50 for By-Laws articles 25, 26, 27, 28, 29, 30, 31, and 32.

Repeated rule violations or non-payment of fines could result in legal action. The payment of a fine does not mean that the owner can leave the violation unresolved. All owners must be in 100% compliance with all By-Laws and Rules. All other By-Law infractions will be governed by the laws of Costa Rica.

SPECIAL RULE

The Board may establish new rules at any time if they are deemed beneficial to the community. These rules will be communicated via email to all owners for their information. If necessary, these rules will be voted on at the next Assembly for continuity or deletion. Owners are responsible for informing their guests or rental agencies of any changes in the regulations.
